Why Mediation?
Family cases often include child custody and visitation, child support, spousal support (otherwise known as alimony), and the use and ownership of property. Having to go to court to decide these issues can take years, cost tens of thousands of dollars in legal fees, and cause irreparable damage to a family. Mediation provides an effective alternative because:

• Mediation is faster, allowing the parties to resolve their differences in a matter of hours
• Mediation is cost effective, often saving the parties thousands of dollars
• Mediation is non adversarial, creating an environment where the parties work together for the benefit of their family

What is Mediation?
In mediation both parties agree to meet with an unbiased third party mediator. The parties each state their respective position to the mediator who then uses their skill and training to help the parties resolve their case. The mediator does not make unilateral decisions in the manner of a judge. Instead they make recommendations to help the parties reach an agreement. The mediator does not represent either party. The parties may attend with their own attorney, although one is not required. If an agreement is reached, the mediator will produce a “Memorandum of Understanding” which defines the agreement. Once signed the agreement may be presented to the court for the judge’s signature, at which time it becomes binding upon the parties.
